1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the EPEVER Learning Management System (“EPEVER LMS”, “LMS”, and “EPEVER Academy” as the case may be), an online platform developed and managed by Beijing Epsolar Technology Co., Ltd. (“EPEVER”). The LMS is designed to provide e-learning courses and educational videos on the solar field, product training, and technical resources related to EPEVER’s products and services (all referred to as “educational content”). By accessing or using the LMS, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, please do not use the LMS.
2. Eligibility and Account Registration
2.1 Use of the LMS is open to individuals, business representatives, installers, distributors, and customers interested in learning about EPEVER’s products and solutions, and any educational content in the solar field.
2.2 To access certain features and courses, users may be required to register for an account by providing accurate, current, and complete information, including a valid email address.
2.3 Each user is responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account. Sharing login information with others is prohibited.
2.4 EPEVER reserves the right to approve, suspend, or terminate any user account at its sole discretion, especially if false information has been provided or the user violates these Terms.
3. Permitted Use and User Conduct
3.1 The LMS is intended for educational and training purposes only. Users may access and use the platform to enhance their understanding of educational content in the solar field.
3.2 Users agree not to:
- Use the LMS for any unlawful, fraudulent, or malicious purpose.
- Copy, download, or distribute content for commercial use without permission.
- Introduce viruses, malware, or attempt to breach the platform’s security.
- Use automated systems (e.g., bots or scripts) to extract content.
3.3 EPEVER reserves the right to monitor user activity and to suspend or block access for behavior that violates these Terms or harms the platform or its users.
4. Intellectual Property and Content Usage
4.1 All content within the LMS — including course videos, PDFs, quizzes, text, images, logos, and software — is the intellectual property of EPEVER or its licensors.
4.2 Users are granted a limited, non-exclusive, non-transferable right to use the content for personal learning or internal company training, in connection with EPEVER products.
4.3 Users are strictly prohibited from:
- Reproducing or redistributing LMS content for external use or resale.
- Modifying or creating derivative works from LMS materials.
- Removing any copyright or proprietary notices from LMS materials.
5. Data Privacy and Protection
5.1 EPEVER respects the privacy of its users and processes personal data in accordance with its Privacy Policy and applicable data protection laws.
5.2 Information collected during account registration and LMS usage (e.g., name, email, IP address, course progress) is used for administrative, support, marketing, and performance improvement purposes.
5.3 EPEVER implements appropriate technical and organizational measures to protect user data from unauthorized access, alteration, or disclosure.
6. Warranties and Limitation of Liability
6.1 EPEVER strives to provide accurate and up-to-date content. However, the LMS and its materials are offered “as is” without any express or implied warranties of any kind, including but not limited to fitness for a particular purpose or non-infringement.
6.2 While EPEVER makes reasonable efforts to ensure LMS availability, it does not guarantee uninterrupted access. Platform downtime, errors, or data loss may occur due to maintenance, upgrades, or unforeseen technical issues.
6.3 To the maximum extent permitted by law, EPEVER is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the LMS.
7. Modifications to Terms and LMS
7.1 EPEVER reserves the right to update or revise these Terms at any time. Changes will be posted on the LMS.
7.2 Continued use of the LMS following the publication of updated Terms indicates acceptance of those changes. Users are encouraged to review the Terms periodically.
7.3 EPEVER may add, remove, or modify features of the LMS at its discretion to improve the user experience or meet operational needs.
8. Governing Law and Dispute Resolution
8.1 These Terms are governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law provisions.
8.2 In the event of any dispute or claim arising from or relating to the LMS or these Terms, the parties shall attempt to resolve the matter amicably. If a resolution cannot be reached, the dispute shall be submitted to the competent courts located in Beijing, China.
